چکیده:
خلافت عباسی یکی از مهمترین دستگاههای حکومتی در جهان اسلام بهحساب میآید. بسیاری از نهادهای اداری و سیاسی تمدن اسلامی در دوره این خلافت شکل گرفت که البته تعداد زیادی از این نهادها به تاسی از ساختارهای ایران پیش از اسلام بوده است. نهاد قضا یکی از مهمترین ساختارهای اداری این خلافت است که گرچه پیش از آن نیز نزد دولتها اسلامی وجود داشت؛ اما سرانجام به دست عباسیان تکامل یافت. ساختارهای نظامی و اجتماعی مختلفی در خدمت نهاد قضائی خلافت عباسی بودند که ازجمله مهمترین آنها میتوان به حسبه، شرطه و دیوان مظالم اشاره کرد. پژوهش پیش روی در پی بررسی جایگاه نهادهای نظامی و اجتماعی نامبرده در ساختار قضائی خلافت عباسی است و سؤال اصلی آن است که این مناصب نظامی و ساختارهای اجتماعی از چه جایگاهی در دستگاه قضائی خلافت عباسی برخوردار بودند؟ که در پاسخ باید گفت یافتههای پژوهش حکایت از آن دارد که این مناصب بخش مهمی از ساختار قضائی آن دوره را در برمیگرفتند. نهاد حِسْبَه، ناظر بر امور اقتصادی، اجتماعی، مذهبی بود و این تشکیلات در ارتباط مستقیم با امر به معروف و نهی از منکر عمل می کرد؛ شرطه ها مامور اجرای احکام قضائی بودند و بازوی اجرائی دستگاه قضا به حساب می آمدند و دیوان مظالم نیز که بخش مهمی از دستگاه قضائی خلافت عباسی بود نقش مهمی در دسترسی مستقیم مردم به خلفا در رسیدگی به شکایات مردم از عمال دولت و دیوانی داشت و مسئول رسیدگی به اعمال ظالمانة حکام، امرا و رجال بزرگ دولت به مردم بود که شخص خلیفه مستقیما مسئولیت آن را بر عهده داشت.
چکیده The Abbasid Caliphate is considered one of the most important governing systems in the Islamic world. Many administrative and political institutions of Islamic civilization were formed during this caliphate, although many of these institutions were derived from the structures of pre-Islamic Iran. The institution of the judiciary was one of the most important administrative structures of this caliphate, that despite its previous existence in Islamic governments, it eventually evolved in the hands of the Abbasids. Various military and social structures served the judiciary of the Abbasid Caliphate, the most important of which were Hasabeh, Shorteh, and Divan-e-Mazalem (the Court of Injustice). The present study seeks to examine the position of the mentioned military and social institutions in the judicial structure of the Abbasid Caliphate and to illuminate the position of these military positions and social structures in the judicial system of the Abbasid Caliphate. The findings of the research indicate that these positions were an important part of the judicial structure of that period. Hasabeh was in charge of economic, social, and religious affairs, and this organization acted in direct connection with "Amr-be-Maroof va Nahy-e-Monkar" (enjoining the good and forbidding the evil). Shortehs (judicial officers) were the executors of judicial rulings and were considered the executive arm of the judiciary. Finally, the Court of Injustice, which was an important part of the judiciary of the Abbasid Caliphate and was directly run by the caliph himself, also played an important role in people's direct access to the caliphs when they dealt with people's complaints about the actions of the governors, commanders, and notable statesmen.

در این دوره از خلفا انتظار میرفت که به مظالم رسیدگی کنند و یکی از وظایف خلفا نیز نشستن آن ها بر مسند دیوان مظالم عنوان شده است .
