Abstract:
زمینه اخلاق نقش مهمی در زمینه حقوق جزا و از جمله مبانی مسیولیت کیفری ایفاء می نماید.یکی از مهم ترین انواع جرایم ، جرایم با مسیولیت مطلق است که در نظام های سیاست کیفری ایران و انگلستان نیز مورد پذیرش قرار گرفته اند. ابعاد و محدوده این جرایم در این دو نظام کیفری با یکدیگر متفاوت است به نحوی که در نظام کیفری ایران صرفا در مورد برخی از جرایم اقتصادی و فساد اداری مورد پذیرش قرار گرفته است در حالی که در نظام کیفری انگلستان دامنه جرایم با مسیولیت مطلق به جرایم منافی عفت و... بسط پیدا کرده است. سوال اصلی در این مقاله با روش توصیفی-تحلیلی صورت گرفته است، این می باشد که مبانی اخلاقی سیاست کیفری ایران و انگلستان در تعیین جرایم با مسیولیت مطلق چیست؟ نتیجه گیری نتیجه تحقیق حاضر آن است که مبانی اخلاقی در سیاست کیفری ایران بر اساس قواعد کلی فقهی لاضرر، قاعده تجری، قاعده اکل مال به باطل و... قابل اشاره است در حالی که در سیاست کیفری انگلستان بر مبنای اصولی مانند اصل مصلحت قابل ارزیابی است.
Background: Ethics plays an important role in the field of criminal law, including the principles of criminal responsibility. One of the most important types of crimes is crimes with absolute responsibility, which are also accepted in the criminal policy systems of Iran and the United Kingdom. The dimensions and scope of these crimes in these two penal systems are different from each other, so that in the Iranian penal system is accepted only for some economic crimes and corruption, while in the British penal system the scope of crimes with absolute responsibility to crimes is accepted. Contrary to chastity, it has expanded. The main question in this article is done by descriptive-analytical method, is what are the ethical foundations of the criminal policy of Iran and the United Kingdom in determining crimes with absolute responsibility?
Conclusion: The result of the present study is that the ethical principles in Iranian criminal policy based on general jurisprudential rules are harmless, practical rule, the rule of property is void, etc., while in British criminal policy based on principles such as the principle of expediency, it can be evaluated.
